Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Publishr macOS application ("App") and related services provided by YMMV LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.


LICENSE AND USE

License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or commercial writing and publishing needs.

Permitted Uses
You may use the App to:

  • Create, edit, and format manuscripts and documents
  • Import and export documents in supported formats (DOCX, PDF, EPUB)
  • Apply styling and formatting to your content
  • Use AI-powered features (subject to additional terms below)
  • Store your projects locally on your device

Restrictions
You may not:

  • Reverse engineer, decompile, or disassemble the App
  • Distribute, sell, lease, or sublicense the App
  • Remove or modify any proprietary notices
  • Use the App for illegal or unauthorized purposes
  • Attempt to circumvent usage limitations or security measures

IN-APP PURCHASES AND SUBSCRIPTIONS

AI Feature Access
The App offers two types of AI feature access:

  • API Key Access: One-time purchase allowing you to use your own OpenAI or Anthropic API keys
  • Premium Subscription: Monthly subscription providing access to AI features through our servers with usage limits

Payment and Billing
All purchases are processed through the Mac App Store. Payment will be charged to your Apple ID account. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Usage Limits
Premium subscribers are subject to rate limits (10 requests per hour, 30 requests per day). API Key Access users have unlimited usage subject to their third-party provider's terms.

Refunds
Refund requests are handled according to Apple's App Store policies. We do not provide direct refunds for purchases made through the App Store.


AI FEATURES AND THIRD-PARTY SERVICES

AI Providers
Our AI features integrate with OpenAI and Anthropic services. When using these features, you acknowledge that:

  • Your content may be transmitted to third-party AI providers
  • Third-party terms of service and privacy policies apply
  • AI-generated content may not be accurate or suitable for all purposes
  • You are responsible for reviewing and editing AI-generated content

API Key Responsibilities
If you provide your own API keys:

  • You are responsible for all charges incurred with the AI provider
  • You must comply with the AI provider's terms of service
  • We are not liable for costs, downtime, or service interruptions
  • API keys are stored securely in your device's keychain

YOUR CONTENT

Ownership
You retain all rights to the content you create using the App. We do not claim ownership of your manuscripts, documents, or other creative works.

Content Responsibility
You are solely responsible for your content and ensure it:

  • Does not violate any laws or regulations
  • Does not infringe on third-party rights
  • Does not contain harmful, offensive, or illegal material
  • Complies with applicable content guidelines

Data Storage
Your content is stored locally on your device. We do not have access to your manuscripts or documents unless you explicitly share them with our support team for assistance.


PRIVACY AND DATA COLLECTION

Local Storage
The App stores your projects, preferences, and settings locally using Core Data. This information remains on your device and is not transmitted to our servers.

Usage Analytics
We may collect anonymized usage statistics to improve the App, including:

  • Feature usage patterns
  • Performance metrics
  • Error and crash reports
  • AI feature usage (anonymized)

Privacy Policy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.


DISCLAIMERS AND LIMITATIONS

Warranty Disclaimer
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI Content Disclaimer
AI-generated content is provided for assistance only. We make no warranties about the accuracy, completeness, or suitability of AI-generated content. You are responsible for reviewing and editing all AI suggestions.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS.

Maximum Liability
Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.


TERMINATION

Termination by You
You may stop using the App at any time by deleting it from your device. Subscription cancellations must be made through your Apple ID account settings.

Termination by Us
We may suspend or terminate your access to the App if you violate these Terms, though we will provide reasonable notice when possible.

Effect of Termination
Upon termination, your license to use the App ends, but your content stored locally on your device remains accessible to you.


UPDATES AND CHANGES

App Updates
We may provide updates to improve functionality, security, or compatibility. Some updates may be required for continued use of the App.

Terms Changes
We may modify these Terms from time to time. We will notify you of material changes through the App or other reasonable means. Continued use after changes constitutes acceptance.


GENERAL PROVISIONS

Governing Law
These Terms are governed by the laws of the jurisdiction where YMMV LLC is established, without regard to conflict of law principles.

Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except for small claims court matters.

Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
